Emerald invalid http

Hi,
I just discovered that the Emerald theme doesnt pass the w3c validator.

I was able top bring it down to 20ish errors but then it gets a bit hairy for a non-web guy.

Is it possible to get it valid out of the box?

Never use this sort of scanners, they just give bullshit and no one really cares (especially developers) about them. There is no error.

This is not an opinion, this is true. For example they say there is an error there : "Error Line 54, Column 57: document type does not allow element "img" here" "var spinner = "<img src='" + spinner_image +"' alt='' />";"
This is totally bullshit
